This Privacy Policy applies to account holders, real estate professionals, visitors who submit information through open house forms, website visitors, and anyone else who interacts with the Service. By using the Service, you agree to this Privacy Policy.
1. About RateMyOpenHouse
RateMyOpenHouse is a software platform designed to help real estate professionals collect open house visitor information, gather property feedback, organize leads by listing, create seller-facing feedback summaries, manage reusable QR codes, and offer visitor incentive gifts when enabled by the account holder. RMOH is a technology provider, not a real estate brokerage, real estate agent, payment processor, gift card issuer, escrow company, lender, title company, or legal advisor.

We collect information you provide directly, information submitted through open house forms, information generated through use of the Service, and information received from third-party service providers.

Payment, Gift, Communications, Technical, and Usage Information
If you purchase a subscription, upgrade your account, add wallet funds, buy credits, or use paid features, payment-related information may be collected and processed by Stripe or another payment processor. If a visitor incentive is offered, we may process information needed to manage or fulfill that incentive, including gift amount, gift status, confirmation status, delivery status, provider reward ID, and related listing details. If you contact us, we may collect your message content and support details. When you use the Service, we may collect IP address, device type, browser type, operating system, pages viewed, referring URLs, access dates and times, app interactions, QR code scans, form views and submissions, error logs, performance data, approximate location based on IP address, cookies, or similar technologies. RMOH does not store full credit card numbers on its own servers.
3. How We Use Information
We use information to provide, operate, secure, support, improve, and market the Service. This includes creating and managing accounts, providing dashboard access, displaying forms, collecting visitor sign-ins and feedback, organizing leads, generating summaries and reports, providing QR code functionality, displaying branding, processing payments and subscriptions, managing credits or paid features, verifying and delivering incentive gifts, communicating with users and visitors, sending service-related messages, detecting fraud or abuse, enforcing our Terms & Conditions, improving features and performance, complying with legal obligations, and protecting our rights, users, visitors, business, and Service. We may also use aggregated or de-identified information for analytics, product development, business reporting, marketing, and service improvement.
4. How Visitor Information Is Used
Visitor information submitted through an open house form may be shared with the hosting real estate professional, team, brokerage, or account holder; used for follow-up about the open house, property, or real estate services; used to collect and organize property feedback; used to create seller-facing summaries or reports; used to verify eligibility for an incentive gift; used to coordinate gift delivery; and used to support, secure, and improve the Service. RMOH does not sell visitor lead information.
5. Seller Summaries and Feedback Reports
The Service may allow account holders to create seller-facing summaries or reports based on visitor feedback. These reports are designed to share property feedback and open house activity and should not include visitor contact information unless the account holder has the legal right and appropriate consent to share that information.
6. How We Share Information
We may share information with account holders, service providers, Stripe or other payment processors, GiftBit or other reward providers, legal authorities when necessary, parties involved in a business transfer, or others with your direction or consent. Service providers may assist with payment processing, subscription billing, gift fulfillment, email delivery, website and app hosting, database storage, authentication, analytics, customer support, security monitoring, error tracking, and business operations.
7. We Do Not Sell Visitor Lead Information
RMOH does not sell visitor lead information. We do not sell visitor names, emails, phone numbers, feedback, or open house submissions to advertisers, data brokers, or unrelated third parties.
8. Cookies and Similar Technologies
We may use cookies, pixels, local storage, analytics tools, and similar technologies to keep users logged in, remember preferences, improve site and app performance, understand usage, detect errors and security issues, improve features and user experience, and support marketing or website analytics. You may be able to control cookies through your browser settings.
9. Data Retention
We retain information for as long as reasonably necessary to provide the Service, maintain business records, comply with legal obligations, resolve disputes, enforce agreements, prevent fraud, and support legitimate business purposes. We may delete, anonymize, or aggregate information when it is no longer needed.
10. Data Security
We use reasonable administrative, technical, and organizational safeguards designed to protect information from unauthorized access, loss, misuse, disclosure, alteration, or destruction. However, no internet-based service, website, app, database, or electronic storage system is completely secure, and we cannot guarantee absolute security.
11. Your Choices
Depending on your relationship with the Service and applicable law, you may be able to access or update account information, export certain visitor or open house information, cancel your subscription, request correction or deletion of certain information, opt out of marketing emails, contact an account holder about communications they send outside RMOH, or contact us at info@ratemyopenhouse.com with privacy-related requests. We may need to retain certain information for legal, security, billing, fraud prevention, dispute resolution, or legitimate business purposes.
12. Visitor Privacy Requests
If you submitted information through an open house form and want to access, correct, or delete that information, you may contact us at info@ratemyopenhouse.com. Because visitor information is often collected on behalf of the agent, team, brokerage, or account holder hosting the open house, we may direct your request to the appropriate account holder or work with them to respond. We may need to verify your identity before fulfilling a request.
13. Account Holder Responsibilities
Account holders are responsible for their own compliance with privacy, marketing, real estate, brokerage, MLS, advertising, and consumer protection laws. Account holders should provide required notices or disclosures, obtain required consent, use visitor information only for lawful purposes, avoid collecting sensitive personal information unless legally permitted and necessary, avoid sharing visitor contact information unless legally permitted, honor applicable privacy requests, and use gift or incentive features lawfully.
14. Children’s Privacy
The Service is not intended for children under 13 years old. We do not knowingly collect personal information from children under 13. If we learn that we have collected such information without appropriate consent, we will take reasonable steps to delete it.
15. California Privacy Rights
California law may provide California residents with certain rights regarding their personal information, including rights to know, access, delete, correct, opt out of sale or sharing where applicable, and not be discriminated against for exercising privacy rights. RMOH does not sell visitor lead information. To submit a California privacy request, contact info@ratemyopenhouse.com. We may need to verify your identity before responding.
16. Notice at Collection for California Residents
The categories of personal information we may collect include identifiers, commercial information, internet or electronic network activity, geolocation information, professional or business information, user-generated content, and inferences such as preferences, account settings, or usage patterns. We collect this information for the purposes described in this Privacy Policy and retain it as described in the Data Retention section.
17. Do Not Sell or Share My Personal Information
RMOH does not sell visitor lead information. We do not sell visitor names, emails, phone numbers, open house submissions, or feedback to advertisers, data brokers, or unrelated third parties. If our practices change in a way that would be considered a sale or sharing under applicable privacy laws, we will update this Privacy Policy and provide required opt-out options.
18. International Users
The Service is operated from the United States and is primarily intended for use in the United States. If you access the Service from outside the United States, you understand that your information may be processed, stored, and transferred in the United States or other locations where our service providers operate.
