Introduction
These Terms & Conditions govern your access to and use of RateMyOpenHouse.com, app.ratemyopenhouse.com, and related services, features, tools, websites, and applications provided by RMOH LLC (“RMOH,” “RateMyOpenHouse,” “we,” “our,” or “us”).
By creating an account, accessing the website, using the app, scanning a RateMyOpenHouse QR code, submitting information through an open house form, purchasing a subscription, or otherwise using the Service, you agree to these Terms. If you do not agree, you may not use the Service.
1. About RateMyOpenHouse
RateMyOpenHouse is a software platform designed to help real estate professionals collect open house visitor information, gather property feedback, organize leads by listing, create shareable seller summaries, manage reusable QR codes, and offer visitor incentive gifts when enabled by the agent or account holder.

RMOH is a technology provider. We are not a real estate brokerage, real estate agent, escrow company, lender, title company, payment processor, tax advisor, or legal advisor.
2. Eligibility
You must be at least 18 years old to create an account or use the Service as an account holder.
- You are legally able to enter into these Terms
- Any information you provide is accurate and complete
- You will use the Service only for lawful business purposes
- You have the right and authority to upload, enter, collect, or process any information you submit through the Service
- If you are using the Service on behalf of a business, brokerage, team, or organization, you have authority to bind that entity to these Terms
Visitors who submit information through an open house form may use the form without creating an account, but they are still subject to these Terms when interacting with the Service.
3. Accounts and Login Credentials
To access certain features, you may need to create an account. You are responsible for keeping your login credentials secure, all activity under your account, keeping account information accurate, and promptly notifying us if you believe your account has been accessed without authorization.
We may suspend or terminate accounts that violate these Terms, misuse the Service, create security risks, or engage in unlawful, deceptive, abusive, or harmful activity.
4. Real Estate Professional Responsibilities
If you use RateMyOpenHouse as a real estate professional, team, brokerage, assistant, or service provider, you are solely responsible for how you use visitor information and feedback collected through the Service.
- Comply with applicable laws, regulations, MLS rules, brokerage policies, advertising rules, fair housing laws, privacy laws, and real estate licensing requirements
- Obtain required permissions or consents before contacting visitors
- Use visitor information only for lawful and appropriate purposes
- Ensure forms, questions, incentives, messages, branding, and communications are accurate and not misleading
- Do not discriminate against any person or group
- Do not collect sensitive personal information unless legally permitted and necessary
- Do not misrepresent your relationship with visitors, sellers, buyers, brokers, brokerages, or third-party providers
RMOH does not verify, approve, or guarantee the accuracy, legality, or compliance of user-created listings, forms, custom questions, branding, marketing language, summaries, or communications.
5. Visitor Information and Feedback
The Service allows visitors to submit information through open house sign-in forms and feedback forms. This may include name, email address, phone number, property feedback, showing preferences, agent interest, buyer interest, or other information requested by the account holder.
- Visitor information may be shared with the agent, team, brokerage, or account holder associated with the open house
- Feedback may be used to create property feedback reports or summaries
- Contact information may be used to follow up about the open house, property, real estate services, or visitor incentive gifts
- If a gift or incentive is offered, information may be used to verify eligibility and deliver the incentive
- Additional terms may apply to third-party gift card providers, email providers, payment processors, or communication tools
RMOH does not sell visitor lead information. Visitor information is used to provide the Service, organize open house activity, help account holders manage leads and feedback, support gift or incentive fulfillment, and operate, secure, and improve the platform.
6. Visitor Incentives and Gift Cards
The Service may allow account holders to offer visitor incentives, such as digital gift cards, promotional rewards, or similar items. Gift incentives may be processed, fulfilled, or delivered through third-party providers, including GiftBit or other reward fulfillment services.
- RMOH does not guarantee that every visitor will qualify for or receive a gift
- Account holders are responsible for setting, funding, and honoring any gift or incentive offer they create
- Gift delivery may depend on visitor eligibility, required confirmation, accurate contact information, provider availability, and account holder settings
- Gift cards and rewards may be subject to issuer, merchant, provider, or GiftBit terms
- Gift availability, redemption options, delivery timing, expiration rules, and restrictions may vary
- RMOH is not responsible for lost, expired, misused, delayed, declined, undeliverable, or incorrectly redeemed third-party gift cards, except where required by law
- RMOH may refuse, cancel, delay, or reverse gift-related activity that appears fraudulent, abusive, mistaken, unlawful, or inconsistent with these Terms
Account holders agree not to use incentives in a misleading, deceptive, unfair, discriminatory, or unlawful manner. The account holder is solely responsible for compliance with any laws or rules that apply to incentives, gifts, promotions, rebates, rewards, or compensation.
7. Payments, Subscriptions, and Billing
Some features of the Service may require payment, a subscription, wallet balance, upgrade, credit purchase, or other paid access. Payments may be processed by Stripe or another third-party payment processor. By purchasing a paid plan or feature, you authorize us and our payment processor to charge your selected payment method for applicable fees, taxes, renewals, usage charges, wallet funding, or other amounts associated with your account.
- Subscription fees are billed in advance
- Subscriptions may renew automatically until canceled
- You are responsible for canceling before your next billing date if you do not want to renew
- Fees are charged in U.S. dollars
- Prices may change with notice
- Taxes may be added where required
- Failed payments may result in suspension, downgrade, or loss of access to paid features
Stripe or another payment processor may collect and process your payment information. RMOH does not store full credit card numbers on its own servers.
8. Cancellations and Refunds
You may cancel your subscription through your account settings, billing portal, or by contacting us at the support contact listed below.
- Subscription payments are non-refundable unless required by law or expressly stated in writing
- Partial billing periods are not refunded
- Canceling stops future renewals but does not automatically refund prior charges
- Paid features may remain available until the end of the current billing period
- Wallet balances, gift credits, promotional credits, open house credits, or similar account credits may be non-refundable and may expire if stated at purchase or issuance
We may issue refunds or credits at our discretion, but doing so in one situation does not require us to do so in another.
9. Free Plans, Trials, Credits, and Promotional Offers
RMOH may offer free plans, beta access, trials, promotional credits, bonus open house credits, discounted subscriptions, or other limited-time offers. We may modify, limit, revoke, or discontinue these offers at any time unless otherwise required by law. Promotional credits have no cash value, are not transferable, may be limited to certain features, and may expire.
10. User Content
The Service may allow you to upload, enter, submit, store, display, or transmit listing information, property photos, agent and brokerage branding, headshots, open house details, custom form questions, visitor responses, feedback summaries, notes, tags, lead information, marketing content, and flyer content. You retain ownership of content you submit, but you grant RMOH a limited, non-exclusive, worldwide license to host, store, process, display, transmit, reproduce, and use that content as necessary to provide, secure, support, and improve the Service. You represent that you have the right to submit and use the content and that it does not violate any law, contract, intellectual property right, privacy right, publicity right, brokerage rule, MLS rule, or third-party right. We may remove or restrict content that we believe violates these Terms or creates legal, security, reputational, or operational risk.
11. Seller Summaries and Reports
The Service may allow account holders to create feedback summaries, seller-facing pages, downloadable reports, or similar materials. These summaries are provided for convenience only. RMOH does not guarantee that summaries are complete, accurate, representative, or suitable for any particular transaction, listing presentation, pricing decision, seller communication, or legal purpose. Account holders are responsible for reviewing summaries before sharing them and should avoid sharing visitor contact information unless they have the legal right and consent to do so.
12. Acceptable Use
You agree not to use the Service to violate laws, rules, regulations, contracts, MLS policies, brokerage policies, or third-party rights; send spam or unlawful marketing messages; upload malicious code; access another user’s account or data; interfere with the Service; scrape, copy, reverse engineer, or misuse the Service; engage in fraudulent, deceptive, abusive, discriminatory, or harmful activity; misrepresent your identity, license status, brokerage, listing relationship, or authority; collect information without proper disclosure or consent; offer incentives in a misleading or unlawful way; harass or harm others; upload content you do not have permission to use; or bypass account limits, paid feature restrictions, security controls, or usage limits.
13. Third-Party Services
The Service may integrate with or rely on third-party services, including Stripe for payments, subscriptions, billing, and customer portal services; GiftBit for digital gift card, reward, or incentive fulfillment; and email, hosting, analytics, authentication, storage, database, communication, export, automation, or integration tools. Third-party services are governed by their own terms and privacy policies. RMOH is not responsible for third-party services, delays, errors, outages, fees, policies, restrictions, or acts or omissions.
14. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect personal information. Account holders are responsible for ensuring that their own use of visitor information complies with applicable privacy, marketing, real estate, brokerage, and consumer protection laws.
15. Communications
By creating an account, submitting a form, or using the Service, you may receive account notices, billing notices, security alerts, product updates, support messages, gift confirmation messages, and other transactional communications. Visitors may receive communications related to an open house, submitted feedback, follow-up, or incentive gift fulfillment. Marketing communications may include an unsubscribe option where applicable. Electronic communications satisfy any legal requirement that such communications be in writing.
16. Data Accuracy and Availability
We work to keep the Service reliable, but we do not guarantee that the Service will always be available, uninterrupted, secure, error-free, or accurate. The Service may be unavailable due to maintenance, updates, third-party outages, internet disruptions, hosting issues, security events, or other circumstances. You are responsible for maintaining your own copies of important data, exports, reports, visitor information, and business records.
17. Intellectual Property
The Service, including the RateMyOpenHouse name, RMOH name, logos, website design, software, code, features, workflows, templates, text, graphics, icons, and other materials, is owned by RMOH LLC or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service unless we give you written permission. You may use materials generated through your own account, such as branded flyers, QR codes, and reports, for your lawful business purposes, subject to these Terms.
18. Beta Features and Changes to the Service
Some features may be offered as beta, experimental, preview, or early-access features. Beta features may be incomplete, change frequently, contain errors, be discontinued, or have limited support. We may add, modify, suspend, or discontinue features at any time and may update pricing, plan limits, credit systems, gift tools, forms, summaries, exports, or other features.
19. Disclaimer of Warranties
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, RMOH disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and security. We do not guarantee that the Service will meet your needs, be uninterrupted or error-free, produce any business result, convert visitors into clients, or that third-party services will operate without interruption.
20. Limitation of Liability
To the fullest extent permitted by law, RMOH LLC and its owners, members, managers, employees, contractors, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, revenue, business, leads, data, goodwill, or transaction-related losses. To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid to RMOH during the three months before the event giving rise to the claim, or $100.
21. Indemnification
You agree to defend, indemnify, and hold harmless RMOH LLC and its owners, members, managers, employees, contractors, affiliates, service providers, and licensors from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of your use or misuse of the Service; violation of these Terms; violation of law or rules; content, listings, forms, questions, branding, reports, incentives, or communications; handling of visitor information; relationships or communications with visitors, buyers, sellers, clients, brokers, agents, teams, or third parties; gifts, incentives, promotions, contests, rewards, or offers; or disputes with visitors, leads, clients, sellers, brokerages, team members, or third parties.
22. Suspension and Termination
We may suspend, limit, or terminate your access to the Service at any time if we believe you violated these Terms; your account creates legal, security, payment, fraud, operational, or reputational risk; your payment fails; your use is abusive, unlawful, deceptive, or harmful; or we are required to do so by law or a third-party service provider. Termination does not relieve payment obligations incurred before termination, and provisions that should survive termination will survive.
23. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service will be handled in the state or federal courts located in California, unless otherwise required by applicable law.
24. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we may provide notice by posting the updated Terms on our website, updating the effective date, sending an email, or displaying an in-app notice. Continued use after updated Terms become effective means you accept the updated Terms.

26. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms presented in the Service, make up the entire agreement between you and RMOH regarding the Service and replace any prior agreements or understandings. If any part is found unenforceable, the remaining parts will remain in effect. Our failure to enforce any part does not waive our right to enforce it later.
